Welcome to NeutralUtilityExchange ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at neutralutilityexchange.sbs (the "Service") operated by NeutralUtilityExchange.
By reserving a charter or utilizing our Service, you assert your acceptance of these Terms. Should you not agree to any section of these terms, then you are ineligible to access the Service.
2. Service Overview
NeutralUtilityExchange offers exclusive yacht charter services, not restricted to:
- Daily yacht rentals
- Sunset sails
- Corporate getaways
- Exclusive celebrations
- Extended charters
Accessibility to services is subject to changes in climate and availability. We retain the right to alter or cease offerings at any period.
3. Booking and Reservations
3.1 Booking Process
For reserving a charter, you are expected to:
- Be of a minimum age of 18 years
- Supply precise and comprehensive details
- Provide the necessary payment as indicated in your confirmation
- Concur with these Terms & Conditions
3.2 Confirmation
A reservation is considered confirmed only after payment has been processed and we send a written confirmation. Service denial is within our rights at our sole discretion.
3.3 Availability
Charter services are reliant on vessel availability and favorable weather conditions. Reasonable efforts will be made to fulfill your requested dates and times.
4. Payment Terms
4.1 Pricing
All fees are stated in € and encompass all applicable taxes unless stated otherwise. Prices are subject to modifications without prior notice.
4.2 Payment Schedule
- Initial Deposit: 50% of the entire charter cost due at time of booking
- Final Payment: Required 48 hours before the departure of the charter
- Incidental fees (if any): Payable following the completion of the service
4.3 Payment Methods
We accept most major credit cards, electronic bank transfers, and certified bank checks. Secure, encrypted procedures are utilized for processing payments.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours prior to departure: Full reimbursement minus processing costs
- Between 24 to 72 hours before departure: 50% refund available
- Less than 24 hours before departure: Non-refundable
5.2 Weather Cancellations
In cases where the weather is considered unsafe by our captain, we will propose to:
- Reschedule the charter to another suitable date without added fees
- Offer a full reimbursement if rescheduling proves to be impossible
5.3 Mechanical Issues
If your designated vessel encounters mechanical problems, we will endeavor to arrange an alternate vessel. Should an alternative not be available, you will be granted a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to all directives provided by the crew
- Utilize safety gear when mandated
- Disclose any health conditions that could impact their safety
- Remain within the designated areas on board
6.2 Prohibited Items
The following are prohibited on board:
- Containers made of glass
- Unlawful substances
- Guns or any form of weaponry
- Excessive quantities of non-alcoholic drinks (beyond reasonable personal consumption)
- Animals (unless pre-authorized)
6.3 Conduct
Patrons are to behave in a courteous manner at all times. A charter can be terminated early without a refund if a passenger's conduct is deemed a safety hazard or significantly disrupts others.
7. Liability and Insurance
7.1 Our Liability
Our accountability is confined to the amount you have paid for the charter. We decline responsibility for:
- Injuries incurred due to a guest's recklessness
- The loss of, or damage to, personal property
- Unforeseen, indirect, or punitive damages
- Delays brought on by weather or situations outside our purview
7.2 Insurance Coverage
Comprehensive marine insurance is maintained by us to cover our vessels and operations. Passengers should secure their own travel and personal insurance arrangements.
7.3 Assumption of Risk
Participating in our charter services means you recognize the inherent dangers involved in marine activities and take responsibility for your own safety and security.
8. Modifications and Itinerary Changes
We reserve the right to adjust itineraries, paths, or schedules due to climatic concerns, safety considerations, or other operational demands. Measures will be taken to offer comparable experiences.
9. Force Majeure
Occurrences beyond our control, inclusive but not limited to:
- Extreme weather events
- Natural calamities
- Regulatory mandates
- Port closures
- Vessel malfunctions
are situations where we are exempt from any liability for delays, terminations, or adaptations caused by such events.
10. Privacy and Data Protection
The management of your private data is in line with our Privacy Policy. Utilizing our services implies consent to the gathering and usage of your information as outlined in our Privacy Policy.
11. Intellectual Property
All content on our website is under copyright and trademark protection, including but not limited to text, images, logos, and graphics. You are prohibited from replicating, distributing, or producing derivative works without prior written consent from us.
12. Governing Law
The laws of Monaco govern these Terms and any arising disputes will be adjudicated in the courts located in Monaco, Monaco.
13. Changes to Terms
